Damit wies das Gericht eine Klage eines Professors zur\u00fcck, der geklagt hatte. Er besitzt einen <a href=\"https:\/\/www.autoteile-markt.de\/shop\/vw-tiguan-ersatzteile-fh92gTiguan\"><strong>VW Tiguan<\/strong><\/a> und bem\u00e4ngelte, dass der tats\u00e4chliche Schadstoffaussto\u00df \u00fcber dem des im beworben Prospekt liegt. Die Manipulation sei mit verh\u00e4ltnism\u00e4\u00dfigen Mitteln abzustellen und stelle keinen erheblichen Mangel dar. Zudem k\u00f6nne der VW \u201e<em>ohne Einschr\u00e4nkung<\/em>\u201c benutzt werden. Trotzdem betonte Richter Streek, dass es sich um einen Mangel handle. Jedoch liege der Mangel unter der sogenannten \u201e1-Prozent-Regelung\u201c. Danach ist ein Mangel erst erheblich, wenn die Reparatur des Mangels \u00fcber 1 Prozent des Kaufpreises liegt. Der VW Tiguan des Klagenden wurde f\u00fcr 38 000 Euro gekauft. Es ist der erste Prozess dieser Art und k\u00f6nnte weitreichende Folgen f\u00fcr alle VW-Fahrer mit Schummelsoftware haben. Der Fall k\u00f6nnte zum Pr\u00e4zedenzfall werden.<\/p>\n<h2>Autohaus zeigt sich kulant<\/h2>\n<p>Trotz der Entscheidung des Richters zeigte sich das Autohaus offen f\u00fcr eine R\u00fccknahme. Der Kl\u00e4ger ist langj\u00e4hriger Stammkunde. Wie viel der Wagen noch wert sein soll, dar\u00fcber soll zwischen den Parteien verhandelt werden. Falls eine Einigung erzielt wird, w\u00e4re das Verfahren beendet.
